In certain areas of Wiltshire some streets have been designated as ‘Prohibited Streets’ or as ‘Consent Streets’.

Trading is not allowed at any time in a ‘Prohibited Street’, and to do so would be an offence.

Trading is allowed in a ‘Consent Street’, but a Street Trading Consent must be obtained first from Wiltshire Council otherwise an offence will be committed. The Consent will state where trading may take place and may restrict the type of goods that can be sold.

In some areas it is also illegal to trade on land to which the public has access, including car parks, forecourts and similar areas, without first obtaining a Street Trading Consent from Wiltshire Council.

Some exemptions do apply and these are listed below:

  • Hawkers/Pedlars operate under the Pedlars Act 1871 and must obtain a Pedlars Certificate from the Police. Pedlars are people who sell from place to place and cannot sell from a fixed pitch. They must move around and not wait for customers to come to them, they cannot stand in any one place for a considerable time nor can they exhort those passing to buy their goods. They can carry their goods and can use a wheeled trolley to transport them.
  • New Vendors/Selling Periodicals eg, the Big Issue are restricted on the location in the street and on the size of stand used, otherwise a Consent or Licence may be required.
  • Charity Stalls will require a Street Collection Permit authorised by Regulations made under the Police, Factories Etc (Miscellaneous Provisions) Act 1916.

A Street Trading Consent is not required in areas which are not covered by a Consent Street Order, but the consent of the landowner will be required and possibly planning consent before any trade takes place.
