Customer notice

As part of the Council's duties under Part IIA of the Environmental Protection Act 1990 ("the Act) the following sites have been investigated and found to be contaminated for the purposes of section 78A(2) of the Act. It should be noted that the Document contents is prescribed by law and is a register of action taken by the council, it is not a register of all the potentially contaminated sites in the county.

Full details of why each site was found to be contaminated is available by clicking on the site name.

Copies of the public register are available for inspection at the relevant area office (the addresses of which are above. Copies can be provided on request however a charge is made. For more details please contact us.

1. Remediation notices served and appeals.

Details of notices served to secure the clean up or making safe of contaminated land. The recipients of such notices may appeals to the Planning Inspectorate against the terms of a remediation notice.

2. Remediation declarations

The council is prevented by the legislation from specifying certain things in a reediation notice. Where this is the case the council must prepare and publish a ‘remediation declaration’. Section 78E(4) &(5)

3 .Remediation statements

In some instances the council is not permitted to serve a remediation na party and they then forward a notification detailing the remediation they claim to have carried out. Section 78R(1)(h) &(j).

5. Appeals against charging notices

Councils are entitled to recover costs incurred in carrying out remediation works from the polluter’. A polluter who receives a charging notice may appeal to the magistrates’ court within 21 days.

6. Other envionmental controls

These pieces of legislation have been amended by the new Environmental Permitting Regulations 2007 which brings these two pieces of licensing law under one umbrella.

7. Special sites

Some secific types of site are designated by the law as ‘special sites’ and these get referred to the Environment Agency for their oversight. These include specific industries such as gasworks or specific conditions such as pollution of ground water.
