Searching the register

Local Land Charges Registers and searches of them were introduced by the Land Charges Act 1925.

The register and the ability to make searches of it were designed to ensure that purchasers of land or property are not caught out by the existence of obligations or restrictions known as 'charges', which are binding against successive owners, by local authorities. The registers form a property-based  information system.

A search result will include any entries recorded against the property being searched - typically, these could include Smoke Control Orders, Conservation Areas, Tree Preservation Orders, financial charges where the Council is able to recover any money owed to it.

About this service

A local authority search is carried out when a property or piece of land is purchased, leased or valued.

A search will establish if any matters may affect the land, such as planning, environmental issues, highways and building regulations.

From 1 August 2007 there are changes to the form for the submission of Local Land Charge Searches (form CON 29). The new form gives you the choice of required and optional parts and clients can now ask for optional questions to be answered individually, at a cost of £15 each.

Each part of the new form is now stand-alone and can be asked for separately if required. Clients can still ask for both parts of the form to be considered together or individually.

Cheques should be made payable to Wiltshire Council. The council does not accept client cheques.

You can order and pay for official searches electronically using one of the three channels linked on the National Land Information Service (NLIS) website. Email nlis@mda.co.uk for more information on electronic payment.

PROPERTY SEARCHES

The Council's Local Land Charges Section (LLC) maintains the Local Land Charges Register, providing a service for Solicitors and ultimately the homebuyer.
Please see below for new charges.

Fees:

  • LLC1 - £35.00
  • Con 29O (Part II) Enquiries - £15.00 per enquiry
  • Additional Enquiries - £20.00 per enquiry
  • Additional parcel of land - £11.50
  • CON 29 ONLY - £105.00
  • Personal Search - £11.00

Searching the Register

There are two ways to find out what is on the Register.

Local search

The first method of finding out what is on the Local Land Charges Register is to submit a Local Search to the Local Land Charges section. This is usually through your solicitor. The solicitor will need to submit various forms and three copies of a site plan. A Local Search involves the completion of:

Certificate of search

"Form LLC1" - this discloses any entries in the register

Forms

Form "Con 29" (stands for Conveyancing Form 29) - this has two parts:

Standard enquiries:

Optional enquiries - i.e: extra areas which the solicitor may feel are relevant in some cases - (eg footpaths, pipelines, or food safety inspections if the premises was a pub for example). There is an extra charge for optional enquiries (see Fees).

Any entries described in the search are given up to and including the date of search only.

Currently we are putting our land charges records onto computer. In due course you will be able to carry out a local search over the web. In the meantime, you can register with the National Land Information Service who enable you to send searches to us electronically. This is probably only appropriate if you are conducting local searches as part of a business.

Personal search

The second method of finding out what is on the Local Land Charges Register is to search in person at the Council offices.

If you would like to carry out a personal search, please make an appointment before your visit - please call 01225 776655 ext 141. We will also need a faxed plan of the property at least 24 hours prior to the appointment time - please fax to 01225 776792. You can download a map online - click here for instructions.

A personal search entails an inspection of the Local Land Charges Register only. It does not include enquiries covered by the "Con 29" form (see above under Local Search).

Personal Searches therefore cost far less (see Fees). You can pay for searches by credit card - please contact us with your credit card details - telephone 01225 776655 ext 141.
