Summary of Service

The presence of flyposting and illegal signs on the highway can compromise the safety of the travelling public by causing a distraction, an obstruction or by affecting forward visibility.

In terms of the Highways Act 1980 Section 132 it is illegal to put up unapproved posters and signs on the highway or attach then to street furniture, trees, structures within the highway. We have powers under the Act to therefore remove any unauthorised posters or signs with no requirement for any action prior to removal. The District Councils also have powers under The Town and Country Planning Act 1990 to remove posters and can also be given delegated powers under The Highways Act 1980.

Details of Service

We already exercise our powers, albeit to a limited degree due to staff and budgetary constraints. The procedure we presently follow is:

  • Flyposting is usually removed and disposed of without attempting to contact the persons responsible.
  • With signs, we attempt to trace the persons/organisations responsible and ask them to remove them voluntarily. Failure to remove the sign/s will then result in us removing them and depositing them in one of our depots. We will then contact the owner and advise them where their signs can be collected.
  • Signs are usually stored in our depots for a month and if the "owner" does not collect it in this time, we dispose of the sign.

What to do if you wish to erect signs on the highway for events and special situations

Temporary signing for events and special situations is governed, like other signing matters, by the national Traffic Signs Regulations and General Directions. Only competent organisations will be allowed to erect signs on the highway and anyone wishing to display signs should approach a competent organisation to carry out the application to us. The current competent organisations approved by us are:

Six to eight weeks notice should be given to any organisation to ensure adequate time to cope with problems.

Payment

Costs are levied by the competent signing organisations.

Eligibility

There are set conditions:

  • The signing must be justified a considerable volume of traffic drawn from far afield.
  • The signs should not be primarily for advertising.
  • The venue should not already be permanently signed unless the additional signing is required to avoid confusion.
  • There should be adequate parking at the venue and signs should not be provided if visitors are expected to use public car parks.
  • Signs should not be used primarily to guide exhibitors' vehicles to the venue unless confusion with other routes cannot be avoided.
  • Signing should normally only be from the nearest A or B road as is the case with tourist signing.
  • Signing to be carried out by a competent organisation.
  • Signing should only be displayed immediately before the event and taken down immediately following it.
  • If signing is required on a regular basis, consideration should be given to a permanent signing scheme provided at the expense of the venue management.
