Highway Records – Personal searches of the records and Con 29 related information
Summary of Service
Our Land Charges section is responsible for providing information in connection with Local Land Charge searches. Generally Solicitors and Licensed Conveyancers submit a search request to the relevant District Council. The search is a statutory requirement in any property or land-based transaction and reveals any planning, environmental health, financial and highway restrictions recorded upon the search subject.
Details of Service
In addition to the services provided to Solicitors and Licensed Conveyancers (via a District Council), you, as a private individual have the right to examine various records held in the Highway Records Section. Access to some documents must be provided free of charge under statute. The following is a list of County Council information required to answer the Con29R and Con29O that can be accessed free of charge.
Appointments
Personal searches can be made between the following hours:
Monday to Thursday 10.00am - 12.00pm then 2.00pm - 4.00pm
Records referred to in the table above can be viewed at: County Hall, Bythesea Road, Trowbridge, see our Contact Us page for maps and directions. We operate an appointments system on a 'first come, first served' basis. We ask that you book at least 24 hours in advance, but not more than 1 week ahead, by telephoning on 01225 713042/043/045/048. We will make every effort to comply with your request for early access to the records, but there may be occasions where, due to high levels of demand or other reasons, this is not practicable. In these cases you will be advised of the reasons and an alternative date suggested. If you are unable to make the appointment, please let us know. Please observe any time restriction that may be attached to your appointment.
You should be prepared to carry out your search without assistance from our staff. We will give you access to the relevant records and it is your responsibility to identify the information and make notes. We will however offer factual clarification but you should have at least a basic knowledge of the search process.
If you would like us to assist you with your search (this includes identification of the property on the record) then a flat fee of £15.00 will apply. This fee is payable immediately and before the assistance is given. The exception to this will be a written undertaking to pay the fee by an authorised person. Payments can be made by cheque to Wiltshire County Council. Charges are currently under review and adequate notice of any changes will be given.
Needs
Personal searchers must notify our Land Charges Team as soon as possible in advance of a proposed visit, and provide:
- The name of the person or company who will be carrying out the personal search.
- The address and the number of searches to be undertaken. This should be faxed to 01225 713981, 24 hours prior to the appointment time.
- The number of searches must be agreed at the time the appointment is made and if you wish to add further searches please notify us 24 hours before the appointment time. Time restrictions will be made according to the number of searches; therefore we cannot guarantee that searches can be added to the same appointment.
- Appointments made not be made further than 1 week in advance.
Payment
