The formal position is that the public highway is for the passage of pedestrians and vehicles, not for parking. In effect, parking on the highway is an obstruction that is 'tolerated'. Accordingly, the County Council, as Highway Authority, does not provide parking for residents. The District Council is the local parking authority and it provides 'off-street' car parks to accommodate the local need for parking.
Where the County Council, as Highway Authority, considers on-street parking controls are required, a traffic regulation order has to be made. This enables the provision of yellow lines where parking is prohibited and white line 'bays' to be marked for authorised parking. The making of an order involves lengthy administrative and legal procedures.
The introduction of restrictions to deal with isolated parking difficulties can often result in a shifting of the problem elsewhere. Accordingly, requests are generally gathered together and considered as part of the comprehensive review of parking in towns.
The comprehensive reviews are, however, extremely time-consuming, requiring resources for analysing the requests, assessing the effect, formulating a comprehensive scheme, consulting, advertising, making and implementing the parking orders.
Requests for new parking controls should be sent in writing to the Director of Environmental Services Department, Wiltshire County Council. Requests form residents parking schemes should be sent to the relevant District Council.
The county council is committed to the introduction of decriminalised parking enforcement across the County. This is where responsibility for enforcing parking controls transfers to the Local Authority from the Police. The decision was made due to the increasing difficulty for the Police in providing effective enforcement and the introduction of new legislation that could require all local highway authorities to adopt decriminalized parking enforcement.
The introduction of decriminalised enforcement will be in operation in Kennet and North Wiltshire in September 2006, with West Wiltshire following in 2008.
Once in place, not only is compliance with parking controls likely to significantly improve but it will also enable easier introduction of the many public requests for new arrangements, such as resident permit schemes and short-stay parking arrangements.
