Why have parking and waiting restrictions?

The council has a duty to manage the streets for the benefit of all road users and residents.  Consequently controls and restrictions are introduced for reasons of safety, traffic flow, environment and access.  These controls and restrictions require effective enforcement to ensure that the objectives are met.

Traffic Regulation Orders

A Traffic Regulation Order (TRO) is a legal order that is required when Wiltshire Council (as Highway Authority) restricts or prohibits an activity on the highway. A TRO is the legal document allowing enforcement of a restriction by the police or civil enforcement officers.

Virtual Permit Orders

A Virtual Permit Order is a legal order that defines the conditions for an electronic form of parking ticket or permit.

Virtual Permits

A Virtual Permit is an electronic form of parking ticket or permit.

To be valid the virtual permit must be registered and paid for by the driver through an account held with Wiltshire Council.

Once a virtual permit has been purchased the driver will not be required to display a parking ticket or permit in the vehicle.

Civil Enforcement Officers download the information regarding which vehicles have paid onto the hand held computers they carry for enforcement purposes.

Drivers have the ability to manage their account online and are able to make changes instantaneously, such as the registration numbers permitted to park, without the need to contact the council.

Experimental Orders

An Experimental Traffic Regulation Order is a legal order that is required when Wiltshire Council (as Highway Authority) restricts or prohibits an activity on the highway by using experimental restrictions that have a maximum duration of 18 months.

TRO Process

It can take several months to design and implement a new scheme involving TROs. Legislative processes have to be adhered to, for example consultation, advertisements (in the local press), objections considered etc.

The necessary road markings and signs must be in place before a TRO can come into effect and become legally enforceable.

Restrictions

A TRO can be made for stationary restrictions; for example parking, waiting and loading restrictions.  

A TRO can also be made for moving restrictions: for example speed limits, weight limits, one way and other prohibition of movement restrictions.

Civil Parking Enforcement (CPE)

Decriminalised Parking Enforcement (DPE) became Civil Parking Enforcement (CPE) on 31st March 2008 when the Traffic Management Act 2004 came into force.

Can I see where a restriction exists, including what type of restriction?

Yes. You can now view a map showing what the restrictions are and where they are.

Each map is called a map schedule. Each map schedule shows the parking and waiting restrictions for a specific area. The conditions relating to the restrictions including permitted exemptions to the controls are contained in the Articles.

Can I read the Articles to the MBTRO?

Yes. The order is divided into two parts, the first part are called the Articles (or preambles), which govern the restrictions and exemptions to the order. The second part of the order is made up of the map-based schedules.  

A to Z of MBTROs and Map Schedules

If you are interested in the restrictions in your area you can view the MBTROs and map schedules to see exactly what restrictions are currently in place.

MBTROs are currently available for the North Wiltshire, Kennet and West Wiltshire districts. The Salisbury district parking and waiting restrictions will be converted from text schedules to map schedules in the near future.
