Wiltshire Housing Sites DPD Examination

Examination - Latest News

Following the close of the public hearing sessions in April, our Inspector - Steven Lee having considered the representations made about the Plan including the contributions made during the hearing sessions has written to us with his post hearing findings and advice.  The letter sets out his preliminary advice about the next steps that will need to be undertaken to make the Plan sound.  This will involve preparing, appraising and consulting on further Main Modifications as set out in his letter. Please note that this is the Inspector’s initial advice and not his final conclusions that will be contained in his report in due course. A copy of the Inspector’s letter is available here.

The Council has welcomed the Inspector’s letter.  In response, a schedule of additional Main Modifications is being prepared to address the points set out in his letter. Once finalised, the schedule will be published for consultation.  

Planning Inspector; Steven Lee BA (Hons) MA MRTPI has been appointed to undertake an independent examination into the soundness of the Wiltshire Housing Site Allocations Plan (the Plan).

The Inspector's task is to consider the soundness of the submitted Plan, based on the criteria set out in paragraph 182 of the 2012 National Planning Policy Framework (the Framework).  The relevant soundness criteria are whether the Plan is:


  1. positively prepared (based on a strategy that seeks to meet objectively assessed development and infrastructure requirements, including unmet requirements from neighbouring authorities where it is reasonable to do so and consistent with achieving sustainable development);
  2. justified (the most appropriate strategy when considered against the reasonable alternatives, based on proportionate evidence);
  3. effective (the plan should be deliverable over its period and based on effective joint working on cross-boundary strategic priorities); and
  4. consistent with national policy (the plan should enable the delivery of sustainable development in accordance with the policies in the Framework). 

The Inspector will take into account the representations submitted upon the Pre Submission Draft Plan and in response to the Proposed Changes as far as they relate to soundness and legal compliance considerations. A number of informal debates will take place on the principal matters identified by the Inspector these are termed Hearing Sessions.

Following the closure of the Examination, the Inspector will prepare a report to the council with precise recommendations, these recommendations may include modifications to the Plan, if such a request is made by the council.

Guidance Notes have been prepared by the Inspector to help people understand the process. Any queries people may have regarding the Examination process should be directed to the Programme Officer who will be happy to assist.

The Programme Officer, Ian Kemp, will act as the contact for any person who has an interest in the Examination and as a liaison between the Inspector, council and representors.

He is an independent Officer of the Examination and works on behalf of the Inspector to organise and manage the administrative and procedural elements of the Examination process. All statements will also be submitted through him.

Any matters that anyone wishes to raise with the Inspector should be submitted via the Programme Officer.

Hearing Sessions Venue and Timetable

Hearing Sessions commenced on Tuesday 2 April 2019 within The Civic Centre, St Stephen's Place, Trowbridge, Wiltshire, BA14 8AH.

A draft Programme for the Hearings is available together with the Inspector's Matters and Issues.

The Inspector issued version 6 of the Programme which included participants for each Hearing and allocated an additional day to consider sites removed from the Plan by the Council at the Focussed Change Stage. The Inspector produced an Explanatory Note providing the background to this decision together with a revised Guidance Note with consequential amendments.
