General Terms and Conditions

Membership of Wiltshire & Swindon Learning Resources (WSLR) is open to all Schools in both maintained and independent sectors in Wiltshire, Swindon and other areas within WSLR’s servicing range.

A school submitting a signed order for subscriber membership of the service enters into a business relationship with WSLR and thereby agrees, for itself and for each of its teachers who use the service, to accept and abide by these Terms and Conditions. No additional service agreement is required.

Any school may subscribe for WSLR's full service or for any alternative service level currently offered, at the school's option, and in doing so agrees to pay when due the current charges for the same.

A subscribing school, by its signed order, commits to membership for a minimum of one year ending on 31 March unless a shorter period has been agreed under the terms of a 'trial period' offered by WSLR, and thereafter remains a member by automatic renewal for succeeding years unless notice of termination has been given. However, the service options subscribed for may be varied with effect from the start of any financial year (1st April) without prior notice.

To terminate membership a school must give WSLR three clear months' written notice to expire at the end of school term 4. Exceptionally, WSLR may, in its sole discretion, agree to accept late notice as notice to terminate membership at the end of term 6.

Each teacher in a member school wishing to use the service will be provided with a personal Username and Password, and will be deemed responsible for all resources requested and issued using the same. A teacher who becomes aware that another person is using his/her Username and Password should inform WSLR, who will issue a new Password. A teacher who moves to another member school will need to obtain a new school-specific Password from WSLR.

Resources must not be transferred from one school to another. Teachers who work at more than one location should lodge separate requests for the resources required for each.

Deadlines for submission of teachers’ requests and details of delivery and collection periods are published on this website under Dates and Deadlines. WSLR will endeavour to meet all teachers' requirements but cannot guarantee to provide every item requested, especially those in high demand or short supply. Late requests will be dealt with after those received within the deadline but it may not then be possible to supply what has been requested, or any suitable alternative.

WSLR does not limit teachers' borrowings from the resources categories for which their schools subscribe, and encourages full use of the service. However, WSLR reserves the right to apply a ‘fair shares’ allocation when necessary and/or to withhold fragile or valuable items from individual teachers when deemed appropriate.

A subscription for the Individual Teacher Option (ITO) provides access for one named teacher to a fixed menu of resources. More than one ITO per teacher may be subscribed for if desired, though generally this will not be an economical option. Substitutions of either teachers or resources, and sharing with or transfers to other teachers, are not permitted.

WSLR will deliver resources to schools at the beginning of Terms 1, 3 and 5 and will advise each school of its delivery date in advance. This date will also be shown on each confirmation of booking, sent to borrowers after processing of their requests.

WSLR will collect resources from each school at the end of Terms 2, 4 and 6, on dates advised in advance. This date will also be shown on each confirmation of booking and on the delivery label on each item issued.

Deliveries or collections made at other times, by request of the school, will be subject to the school agreeing to reimburse the transport and other costs involved. Borrowers are always welcome to collect resources from or return them to WSLR in Trowbridge.

All items due for return should be ready at the pick-up point by 8am on the collection date. Any items not returned via WSLR van collection must be returned by the borrower taking them to WSLR headquarters in Trowbridge or to a designated public library. In the latter case borrowers should contact the library in advance to ensure they have room to store the items until collected.

A school using the public library facility for late returns (or for receipt of late-requested items) thereby agrees to pay a standard charge of £15 per instance (of which, £10 is levied by the library service) to reimburse transport and other costs incurred.

If WSLR needs to send a van to school to collect multiple or large items which were not ready for collection on the date advised, a charge will be payable to cover transport and other costs incurred.

Borrowers are expected to take reasonable care of resources supplied, to check and advise WSLR of any items missing or damaged on delivery, and to return all items in good condition and packed in the same containers and/or sets in which they were delivered.

Borrowers should take care not to send to WSLR any items the property of the borrower's school or pupils. WSLR will normally set aside such items on receipt but is not responsible for any that may be lost or mislaid. WSLR normally will return such items with the next delivery but reserves the right to request that they be collected by owner or that the owner reimburses postal or other costs incurred in returning them.

It is a condition of borrowing that each school agrees to pay WSLR’s charges arising in the event of failure to return loaned items within a reasonable period of time, or at all, or if loaned items are returned with part(s) missing or damaged (beyond fair wear and tear) or, in the case of a boxed book collection, incomplete or with incorrect contents requiring replacement and/or re-sorting.

The applicable charges are published from time to time and all member schools are deemed to have had notice of them. Details of current charges are available from the WSLR office. Charges reflect the costs of repair or replacement and/or the work needed to rectify the loss, breakage or mis-sorting and packing of resources. All charges can be avoided by borrowers taking care to return items when due, in good condition and properly sorted and packed.

Books

Numbered boxed book collections are loaned as sets and it is important that all books are returned in the correct box. The number on each book must correspond with the number on the box and there must be the right number of books (as shown on the delivery label) in the box.

Books with green spots on the cover must not be included with numbered collections but may go in any other box. Again, the box must be complete with the right number of books as shown on the delivery label.

No label or other attachment should be affixed which obscures any part of the WSLR book number or barcode label. Any label or other item affixed to a book must be removed without trace before the book is returned to us. Books returned damaged by the attachment of such items may be charged for.

Visual Resources

Borrowers are responsible for checking the contents of each box upon receipt, against the list on the inside of the lid, and again before returning it to us. Any items missing or damaged on receipt must be reported promptly to WSLR, otherwise it will be presumed that the box and contents were received complete and in undamaged condition.

Boxes should be handled, unpacked and repacked under adult supervision, with due regard for any packing instructions or guidance provided.

All resources are for use in the classroom but some are particularly fragile, valuable, or difficult to replace. Borrowers are requested to supervise their use and to ensure that children take due care when handling them. In the event of damage or breakage, do not attempt a repair and do not dispose of the item but gather all the pieces, wrap safely in the box and return when due.

Audio-Visual Resources

WSLR will fulfil all requests (received within the deadline) for Educational Programmes and Feature Films listed in our catalogue, as we hold master recordings and are licenced to make copies to order.

However, only limited copies are held of each title in the Music CD, Educational Producers’ DVDs and Interactive CD-Roms collections and we may not be able to supply all borrowers with their first choice. NB: it is WSLR policy not to send more than one copy of any A-V resource title to a single school.

To ensure compliance with the terms of WSLR’s Educational Recording Agency licence, it is a specific condition of borrowing that each school agrees and undertakes that no Audio-Visual item provided by WSLR to a member school shall be loaned to any third party, nor removed from school premises other than for preview purposes in the course of lesson preparation.

Unauthorised copying, reproduction, republishing, uploading, downloading, posting, exhibition, transmission or duplication of any educational programme, feature film, dvd, cd-rom or music cd provided by Wiltshire & Swindon Learning Resources is prohibited.

Clips Vault - additional Terms & Conditions

The video clips comprised in the WSLR Clips Vault are available for educational use in recognised schools only. All clips are copyright. Access to the clips is available only to teachers in schools that have paid or agreed to pay WSLR a subscription for access to Audio-Visual Resources. All other persons are permitted to access only the demonstration clips available through the clips introductory page. Each school subscribing for Audio-Visual Resources and each teacher in such school agrees and undertakes that: the clips shall be accessed only by them and used for educational viewing only; that no password for access to the clips shall be disclosed to or used by any party other than the person to whom it was issued; and that no attempt shall be made to copy, download, manipulate, alter, transfer or store any clip(s) onto or by means of any medium, equipment or device of any kind or in any manner whatsoever.
